Right to get Government Aid

In September 2021, the Supreme Court of India ruled that Government Aid to an institution is not a fundamental right. The finer points of the ruling include:

  • It said that a decision to grant aid is matter of policy and is determined by financial constraints and deficiencies.
  • With respect to aided institutions, there cannot be any difference between a minority and non-minority institution.
  • Grant of aid brings binding conditions and the institution receiving aid is bound to comply with them.
  • An institution can decline the grant if it does not want to accept the conditions. However, it cannot say that the grant must be on its own terms.
