Nikah-Halala

Recently, a Constitution Bench of the Supreme Court decided to hear a batch of petitions challenging the constitutional validity of the practice of Nikah Halala allowed by Muslim personal law.

Nikah-Halala: It is a practice under which a woman who wishes to remarry the man who gave her triple talaq, first has to get married to another man, consummate the marriage, get divorced, and observe a period of separation called ‘iddat’ or ‘iddah’. Only after this can she marry her ex-husband.

  • Indian Law on Nikah-Halala: In India, the Muslim Women’s Protection of Rights on Marriage, passed after invalidation of triple talaq by the Supreme Court, is silent on nikah halala.
