Legislatures Enacting Laws Not Contempt of Court: Supreme Court

In June 2025, in a significant ruling, in Nandini Sundar & Ors. vs State of Chhattisgarh (2025), the Supreme Court (SC) held that enacting legislation does not amount to contempt of court, reaffirming the constitutional principle of separation of powers.

Background of the Case

  • The case arose from two 2007 writ petitions challenging the Salwa Judum, a state-supported anti-Maoist militia in Chhattisgarh, accused of serious human rights violations in Dantewada.
  • A major issue was the use of tribal youth as Special Police Officers (SPOs).
