Separate Wards for Transgender Jail Inmates

Recently, the Centre has asked states to safeguard the rights of transgender people in jails and ensure separate wards to protect them against any form of exploitation.

  • The advisory was issued in light of The Transgender Persons (Protection of Rights) Act, 2019, which came into effect from January 2020.
  • The law provides for recognition of the identity of transgender persons, prohibition against discrimination and including them in education, health, social-security facilities as well as other welfare measures of the government.

Yogyakarta Principles

  • The Yogyakarta Principles is a document about human rights in the areas of sexual orientation and gender identity, published as the outcome of an international meeting of human rights groups in Yogyakarta, Indonesia, in November 2006.
  • The principles and the supplement contain a set of precepts intended to apply the standards of international human rights law to address the abuse of human rights of lesbian, gay, bisexual, transgender, and intersex (LGBTI) people.
  • The YP plus 10 was adopted on 10 November, 2017 to supplement the Yogyakarta Principles.

Nelson Mandela Rules

  • Also known as the Standard Minimum Rules for the Treatment of Prisoners, it was first adopted in 1957, and in 2015 was revised and adopted as the Nelson Mandela Rules.
  • The Rules give guidance on all aspects of prison management, from admission and classification to the prohibition of torture and limits on solitary confinement.
  • There is guidance on healthcare, recruitment and training of prison staff, as well as disciplinary sanctions.
