Childcare Leave: A Constitutional Right of Women
On 22nd April, 2024, the Supreme Court (SC), in a landmark judgment, held that participation of women in the workforce is a constitutional entitlement and denying a mother child care leave violates this entitlement.
- A bench led by Chief Justice of India was hearing a plea by a woman, who said despite exhausting her existing leaves, the Himachal Pradesh government declined to grant her childcare leave, citing the absence of a specific provision in the state’s service rules similar to Section 43-C of the Central Civil Service (Leave) Rules.
