The Indian Constitution accords special status to the state of Jammu and Kashmir. First Schedule of the Constitution refers Jammu and Kashmir as a part of the territory of India. Under Art. 370, the powers of the Parliament to make laws for the state shall be limited to those matters in the Union list and the Concurrent list which are in concurrence with the government of the state.
The residuary powers in respect of Jammu and Kashmir rest with the State Government and not with the Union Government.
