Supreme Court Moots Stronger Enforcement Provisions against IPR Infringement

Recently, speaking at the National Seminar on adjudication of IPR disputes in India, the Chief Justice of India (CJI) said that there was a need for stronger action against acts of infringement of intellectual property rights.

  • The CJI pointed out that the vesting back of IPR jurisdiction in High Courts from Intellectual Property Appellate Board (IPABs) has come at a time when the system is overburdened with backlogs.
  • On the judicial setup to deal with IPR issues, the CJI said it is necessary to strengthen the High Courts to deal with these cases.
