Supreme Court Upholds DNA Test in Paternity Disputes
On 29th May 2026, the Supreme Court, in CP v. AP (2026 INSC 600), upheld the use of a DNA test in a long-running paternity dispute, clarifying the circumstances under which courts may direct DNA testing while balancing the right to privacy with an individual's right to establish parentage.
- Prior to this judgment, the Supreme Court had consistently held that DNA tests should be ordered sparingly and only in exceptional circumstances. However, there was no clear legal standard specifying the exact situations in which such tests could be permitted.
