Supreme Court Raises Concerns on Sex Trafficking Legislation
On 12th November, 2024, the Supreme Court (SC) expressed severe dissatisfaction with the Central Government for its failure to implement comprehensive legislation against sex trafficking, a directive that has been pending since December 2015.
Concerns Raised by the SC
Organised Crimes Investigating Agency (OCIA)
- In Prajwala vs. Union of India, 2015, case, the SC directed the Ministry of Home Affairs (MHA) to establish the OCIA to address sex trafficking.
- However, despite the deadline of 30th September 2016, it was never established.
Limitation of NIA
- The SC questioned the efficacy of National Investigation Agency (Amendment) Act, 2019.
