Concerns of PwDs over DPDP Rules
Recently, disability rights activists are criticising the draft Digital Personal Data Protection Rules (DPDP) that infantilises Persons with Disabilities (PwDs) and negates their decision-making capabilities.
What are the concerns?
Issue of Guardianship: Guardianship is governed two laws:
- Rights of Persons with Disabilities (RPWD) Act, 2016: Provides for limited guardianship, allowing PwDs some decision-making rights.
- National Trust Act (NT Act), 1999: Grants full guardianship for PwDs with autism, cerebral palsy, and intellectual disabilities.
- DPDP Act does not differentiate between these laws, creating confusion over decision-making authority.
- Denial of Digital Autonomy: Section 9(1) assumes that PwDs with legal guardians do not make independent digital decisions.
