Amendment to the Conduct of Election Rules
On 20th December 2024, the Ministry of Law and Justice issued a notification amending Rule 93(2)(a) of the Conduct of Election Rules, 1961.
Background
- The amendment follows a contentious ruling by the Punjab and Haryana High Court in the Mahmoud Pracha vs. EC case. Pracha, a lawyer, had sought access to extensive election records related to the Haryana assembly elections held in October, 2024.
- The Election Commission of India (ECI), opposing Pracha’s request, argued that since he was not a candidate in the Assembly elections, he was not entitled to the election-related documents.
