Suit for Specific Performance
Recently, the Supreme Court set aside the decree passed in a civil suit for specific performance filed in 1999 for the enforcement of an agreement to sell executed in 1986.
About Specific Performance
- Specific Performance is an equitable remedy that obliges one party to carry out, to the greatest extent possible, the obligations stipulated in the contract.
- It is typically used in cases where monetary damages are not considered an adequate remedy for the aggrieved party.
- It is dealt with under Specific Relief Act (SRA), 1963.
