Supreme Court Judgment on Private Property Acquisition
On 16th May, 2024, the Supreme Court (SC) of India ruled that any acquisition of private property by the state must meet a set of criteria under Article 300A of India’s Constitution, which includes being carried out for a public purpose, following the law, and following proper procedure.
The Supreme Court delivered the ruling in the case of Kolkata Municipal Corporation & Anr. vs. Bimal Kumar Shah & Ors.
