Discuss the amending power of the Parliament under Article 368. Can Parliament amend the basic structure of the Constitution under its amending power?
Answer: Article 368 under part XX of the Constitution empowers the Parliament to amend the Constitution and its procedure. It says, Parliament under its constituent power can amend by way addition, variation or repeal any provision of the Constitution as per procedure.
Moreover, amendment to the Constitution is subjected to certain condition such as:
- Bill to the amendment can only be introduced in Parliament and not is state legislature.
- Bill introduced in Parliament does not require prior consent of president.
- Bill must be passed by each house separately.
