The Biological Diversity (Access to Biological Resources and Knowledge Associated thereto and Fair and Equitable Sharing of Benefits) Regulations, 2025

On 29th April 2025, the National Biodiversity Authority released new regulations guiding the fair and equitable sharing of benefits arising from the use of biological resources, including digital sequence information.

  • The 2025 Regulation replaced the 2014 guidelines and now includes digital sequence information.

New Regulations

Turnover-Based Benefit Sharing

  • Entities utilizing biological resources will contribute a percentage of their annual turnover based on their gross ex-factory sale price (excluding taxes):
    • Below Rs.5 crore: Exempt from benefit sharing
    • Rs.5 crore–Rs.50 crore: 0.2% of annual turnover
    • Rs.50 crore–Rs.250 crore: 0.4% of annual turnover
    • Above Rs.250 crore: 0.6% of annual turnover
