Governor's Power to Dismiss the Ministers
On 29th June, 2023, Tamil Nadu Governor dismissed a Minister from the cabinet, who had been arrested, but later suspended the order following a request from Union Home Ministry.
- Article 164(1) states that Ministers hold office at the Governor's pleasure, but constitutional experts argue the Governor can't remove a Minister without the Chief Minister's approval.
- In State of Punjab vs. Principal Secretary to the Governor (2023), the Supreme Court (SC) underlined that political differences in a democratic polity have to be worked upon and sorted out with a sense of sobriety and maturity.
