The Transgender Persons (Protection of Rights) Amendment Act, 2026

On 30th March 2026, President Droupadi Murmu gave her assent to the Transgender Persons (Protection of Rights) Amendment Bill, 2026.

Re-defining Identity and Self-Determination

  • The Act proposes to abolish the right to self-identification, replacing the existing purely administrative certification process.
  • It introduces a narrower definition focusing on specific socio-cultural groups like Kinner, Hijra, Aravani, and Jogta.
  • This shift contradicts the NALSA v. Union of India (2014) judgment which recognized self-perceived gender identity.

Medicalization and Administrative Oversight

  • A Medical Board headed by a Chief Medical Officer must now recommend identity certificates to the District Magistrate.
