Model Code of Conduct (MCC)
The MCC is a set of guidelines issued by the EC to regulate political parties and candidates prior to elections.
Constitutional Provisions: The Election Commission of India derives its mandate to formulate MCC under Article 324 of the Constitution.
Legal Provisions: Certain provisions of the MCC may be enforced through invoking corresponding provisions statutes like the Indian Penal Code, 1860, Code of Criminal Procedure, 1973, and Representation of the People Act, 1951.
Judicial Pronouncements: The Supreme Court in its judgment (S. Subramaniam Balaji Vs Govt. Of Tamil Nadu and Others) has directed the Election Commission to frame guidelines with regard to the contents ....
