AI in Courts: Efficiency Tool or Risk to Judicial Reasoning?
The Kerala High Court recently issued guidelines titled “Policy Regarding Use of Artificial Intelligence Tools in District Judiciary” to regulate AI use in the lower courts. As the first formal policy in India to address AI adoption in courts, it lays down strict safeguards and clear directions.
Issues in the Use of AI in Judiciary
- Errors in Translation and Transcription
- AI tools often mistranslate legal terms (e.g., “leave granted” translated as “holiday approved”).
- Transcription systems mishear words, misidentify names, or even invent sentences (“hallucinations”), creating risks in judicial records.
- Bias and Reliability in Legal Research
- Search engine bias can skew results, excluding relevant precedents.
