Supreme Court Directs Oversight on Silicosis-Related Issues

On 7th August, 2024, the Supreme Court has mandated the National Green Tribunal (NGT) to oversee and ensure compliance regarding the impact of silicosis-prone industries in India, while also addressing compensation for affected workers.
- Silicosis is a serious and incurable occupational lung disease caused by prolonged inhalation of silica dust.
- The Court emphasized that statutory bodies like the NGT are better positioned to enforce legal mandates and oversee these matters.
- The NGT is also directed to take any additional measures necessary to prevent the spread of silicosis in affected industries.
- Adequate compensation for workers affected by silicosis or their families must be expedited, with the National Human Rights Commission (NHRC) overseeing the compensation process across states.
- The Employees' State Insurance Corporation and state chief secretaries are instructed to collaborate with the NHRC to ensure efficient and timely compensation distribution.
- The Supreme Court has ordered that all relevant reports and affidavits related to this issue be forwarded to the NGT and NHRC to support effective execution of their responsibilities.
